    SAVR App Terms of Use and End User Licence Agreement

    1. About These Terms

    These Terms of Use and End User Licence Agreement (Terms) are an agreement between you and SAVR Pty Ltd (ABN 69 645 533 642) (SAVR, we, us or our) governing your access to and use of the SAVR tyre pressure monitoring mobile application, including its software, services, content, updates and features (App).

    By downloading, installing, accessing, creating an account for, purchasing a subscription through or using the App, you agree to these Terms. If you do not agree, you must not use the App.

    These Terms should be read with our Privacy Policy and any separate terms, instructions, product warranty or terms of sale applying to SAVR sensors or other hardware. If there is an inconsistency concerning how we handle personal information, the Privacy Policy applies to that extent.

    2. What the App Does

    The App is designed to work with compatible SAVR tyre pressure monitoring system (TPMS) sensors and may allow you to view or manage information such as:

    • tyre pressure and sensor temperature readings;
    • sensor status, battery status and identification;
    • vehicle, trailer, caravan, motorcycle, motorhome or multi-axle profiles;
    • wheel-position and sensor assignments;
    • pressure and temperature alert thresholds;
    • warnings, notifications and audio alerts;
    • historical tyre information, maintenance information and other SAVR+ features; and
    • other functionality we introduce from time to time.

    Features may vary by device, operating system, country, App version, connected hardware and subscription level. Some features may require Bluetooth, internet access, device permissions, compatible hardware or a paid subscription.

    3. Safety: Your Responsibility for the Vehicle

    The App is a monitoring aid. It is not a substitute for physically checking your tyres, and it is not a safety device that should be relied on by itself.

    You remain responsible for deciding whether your vehicle, tyres, caravan, trailer or other equipment are safe to operate. Your responsibilities include, where relevant:

    • performing appropriate pre-trip inspections;
    • checking tyre pressures manually at appropriate intervals;
    • checking tread, tyre condition, sidewalls, valves and valve stems;
    • maintaining tyres, wheels, bearings, brakes, suspension and the vehicle generally;
    • using pressures and load limits appropriate to the vehicle and tyres;
    • following vehicle, tyre, caravan, trailer and equipment manufacturer instructions; and
    • obtaining qualified tyre, mechanical or roadside advice when reasonably required.

    A lack of warning, an apparently normal reading or a connected sensor does not mean that a tyre, wheel or vehicle is safe.

    4. Tyre Failures the App May Not Detect

    Tyre and wheel failures can occur in different ways. The App and sensors may not detect, predict or provide useful advance warning of every problem.

    For example, a sudden blowout, rapid pressure loss, tread separation, sidewall failure, impact damage, valve failure, wheel failure, bearing failure or other mechanical problem may develop too quickly, may not change pressure in a detectable way before failure, or may not be detected by the sensor.

    You must not treat TPMS monitoring as a guarantee against tyre failure, vehicle damage, an accident or injury.

    5. Pressure and Temperature Readings

    TPMS readings are generated by electronic sensors and are subject to normal measurement tolerances, installation conditions and environmental effects. Readings may differ from another pressure gauge or measuring device.

    Pressure and temperature can be affected by ambient temperature, altitude, weather, sunlight, vehicle speed, load, braking, tyre construction, sensor position, sensor age and other conditions.

    An external valve-mounted TPMS sensor does not directly measure the precise internal temperature of the tyre carcass, wheel bearing, brake assembly or other vehicle component. Temperature information should therefore be treated as an additional indicator rather than a diagnostic measurement of those components.

    Where a reading appears unusual or safety-critical, verify the tyre and vehicle using an appropriate physical inspection or measuring device before relying on the reading.

    6. Alert Thresholds and Vehicle Setup

    You are responsible for selecting and maintaining appropriate pressure and temperature thresholds for each vehicle and tyre configuration. Any default, suggested, previously saved or example setting is provided for convenience only.

    You should use appropriate sources such as the vehicle tyre placard, vehicle manufacturer, tyre manufacturer, caravan or trailer manufacturer, and qualified tyre or automotive advice.

    You are also responsible for ensuring each sensor is assigned to the correct wheel position. An incorrectly assigned sensor can cause the App to display a valid sensor reading against the wrong tyre.

    Review your settings after changing vehicles, tyres, loads, wheel positions, sensors or towing configurations.

    7. Alerts, Bluetooth and Background Operation

    The App depends on mobile-device and wireless technology that can occasionally fail, be interrupted or operate differently from expected. SAVR does not guarantee continuous communication between a sensor and your phone or that a particular alert will be displayed, heard or received at a particular time.

    An alert or sensor reading may be delayed, interrupted, inaccurate or unavailable because of circumstances including:

    • Bluetooth being disabled, interrupted or outside effective range;
    • wireless interference, physical obstructions or radio conditions;
    • low, depleted, damaged or incorrectly installed sensor batteries or sensors;
    • your phone being powered off, restarted, low on battery or unavailable;
    • the App being force-closed, suspended or terminated by the operating system;
    • background-processing, Bluetooth-scanning or battery-optimisation restrictions;
    • notification permissions, notification settings, Focus, Do Not Disturb or similar modes;
    • muted audio, reduced volume or audio-routing settings;
    • CarPlay, Bluetooth audio or another connected device affecting how audio or notifications are presented;
    • mobile operating-system changes or updates;
    • device compatibility, storage, memory or other device limitations;
    • internet or cloud-service outages where online services are required; or
    • other circumstances outside SAVR's reasonable control.

    You are responsible for enabling the permissions and device settings reasonably required for the features you wish to use, keeping your phone adequately charged, and keeping the App and operating system reasonably current.

    8. Responding to Alerts and Safe Use While Driving

    Do not interact with the App in a way that distracts you while driving. You must comply with all applicable road rules, mobile-phone laws and distracted-driving laws.

    Configure the App and vehicle profile before driving wherever reasonably possible. If an alert requires attention, do not make a sudden or unsafe manoeuvre solely because of the alert. Reduce speed where appropriate, stop at a safe location when it is safe to do so, and inspect the tyre or vehicle before continuing if the circumstances require it.

    If you are uncertain whether it is safe to continue driving, obtain appropriate roadside, tyre or mechanical assistance.

    9. Sensors, Installation and Maintenance

    The App is designed for compatible SAVR sensors. We do not promise that it will operate correctly with sensors or hardware supplied by another manufacturer unless we expressly state that they are supported.

    You are responsible for correctly installing and maintaining sensors and following the instructions supplied with them. This includes, where relevant:

    • fitting sensors to suitable and serviceable valve stems;
    • securing sensors correctly and using supplied anti-theft or retaining components where instructed;
    • confirming that each installed sensor is communicating and mapped to the correct wheel;
    • checking sensors and valve stems periodically for damage or deterioration;
    • replacing sensor batteries when required; and
    • removing or replacing a sensor that appears damaged, loose, incompatible or unreliable.

    External valve-mounted sensors add weight to the valve assembly. You should ensure that the valve stems and wheel setup are suitable for the equipment being fitted and obtain professional advice where appropriate.

    Physical sensors are goods and may also be subject to separate terms of sale, product instructions and warranty conditions. Nothing in these Terms removes statutory rights applying to those goods.

    10. Device, Vehicle and Service Compatibility

    The App requires a compatible mobile device, supported operating system, Bluetooth functionality and compatible hardware. We do not guarantee compatibility with every phone, tablet, operating-system version, vehicle, tyre, valve stem, infotainment system, CarPlay implementation, aftermarket accessory or third-party product.

    Apple, device manufacturers, vehicle manufacturers and other third parties can change their technology without our control. A third-party update may affect functionality that previously worked.

    11. Internet Access and Telecommunications Charges

    Some TPMS functionality may operate using Bluetooth without an active internet connection. Other features may require internet access, including account services, cloud synchronisation, backups, historical information, subscriptions, support, analytics, maintenance features or App updates.

    You are responsible for any mobile data, roaming, internet or telecommunications charges associated with your use of the App.

    12. Accounts and Account Security

    Some features may require a SAVR account. If you create an account, you must provide information that is accurate and reasonably current and keep your login credentials secure.

    You are responsible for activity carried out through your account unless caused by a security failure for which SAVR is legally responsible. Tell us promptly if you reasonably suspect unauthorised access or compromise.

    You must be at least 16 years old to create an account, or otherwise use the App with the consent and supervision of a parent or legal guardian where permitted by law.

    You may request deletion of your account through the App where available. Account deletion does not necessarily cancel an Apple App Store or other third-party subscription.

    Personal information will be deleted, de-identified or retained in accordance with our Privacy Policy and applicable law, including ordinary backup and legal-retention processes.

    13. Licence to Use the App

    Subject to these Terms, SAVR grants you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable licence to download and use the App on devices that you own or control for personal use or legitimate internal business use.

    The App is licensed, not sold. SAVR and its licensors retain all rights not expressly granted to you.

    14. Prohibited Conduct

    Except where applicable law gives you a right that cannot be restricted, you must not:

    • copy, modify, adapt, translate or create derivative works from the App;
    • reverse engineer, decompile, disassemble or attempt to derive source code;
    • rent, lease, lend, sell, sublicense, distribute or commercially exploit the App or access to it;
    • remove or obscure proprietary notices;
    • circumvent subscription entitlements, paid features, security measures or access controls;
    • scrape, harvest or systematically extract data from the App or our systems;
    • use the App or its proprietary materials to develop a competing product through unauthorised copying or extraction;
    • introduce malware, interfere with the App or infrastructure, or attempt unauthorised access;
    • impersonate another person or misuse another user's account; or
    • use the App for an unlawful, fraudulent or abusive purpose.

    15. Paid Features and Subscriptions

    The App may include optional paid features or subscriptions, including SAVR+ or other premium functionality. The price, billing period, renewal type, included benefits and any trial or introductory terms will be displayed before purchase.

    15.1 Automatic Renewal

    If you purchase an automatically renewing subscription, it will continue and the relevant payment method will be charged for each billing period until it is cancelled in accordance with the cancellation arrangements displayed at purchase and provided by the relevant payment platform.

    15.2 Trials and Introductory Offers

    A free trial or introductory offer may convert to a paid subscription when the promotional period ends if that is disclosed at the time you subscribe. Eligibility conditions may apply.

    15.3 Managing and Cancelling a Subscription

    Subscriptions purchased through Apple are generally managed through the relevant Apple account or subscription-management service. Where required by platform rules, the App will provide an accessible route to subscription management or cancellation.

    Deleting the App or deleting your SAVR account does not necessarily cancel a subscription. You must use the cancellation method applicable to the subscription.

    15.4 Refunds

    Refund requests for purchases processed through an app store may be administered by the relevant app store or by SAVR where permitted.

    Nothing in these Terms limits a refund, remedy or other right available under applicable consumer law.

    15.5 Price and Packaging Changes

    We may change subscription prices, plans or how features are packaged for legitimate business reasons, including changes in functionality, service costs, technology, taxes, exchange rates or the scope of the service.

    We will provide any notice, consent process, cancellation rights or other protections required by applicable law or the relevant app store.

    We do not promise that a feature that is free today will remain free indefinitely or that a particular feature will remain available forever. However, changes to paid services remain subject to applicable consumer law and platform requirements.

    16. Updates and Changes to the App

    We may update, modify, improve, replace, add to or remove App features from time to time for reasons including security, reliability, compatibility, legal compliance, platform requirements, product development or commercial viability.

    Some updates may be required for the App or particular features to continue working. Your app store may install updates automatically depending on your settings.

    Where a material change adversely affects a paid subscription, we will provide any notice, cancellation right, refund or other remedy required by applicable law or platform rules.

    17. Availability and Discontinuation

    We aim to operate the App and connected services reliably, but we do not promise uninterrupted, continuous or error-free operation. Maintenance, faults, cyber incidents, telecommunications failures, platform outages and events outside our reasonable control may interrupt service.

    We may discontinue the App or a material service if reasonably necessary. Where a paid service is materially affected, we will take reasonable steps to provide notice and comply with applicable consumer law and platform requirements, including any refund or other remedy that is legally required.

    18. Beta, Testing and Pre-Release Features

    We may offer beta, testing, preview or experimental features. These features may be incomplete, may contain errors, may behave unpredictably and may be changed or withdrawn.

    You should exercise additional caution with pre-release functionality and must not rely on experimental functionality as your sole source of safety-related information.

    19. Privacy and Permissions

    Our collection, use, storage and disclosure of personal information is described in the SAVR Privacy Policy at:

    The Privacy Policy forms an important part of how the App operates and should be read with these Terms.

    Depending on the features you use, the App may process account details, device information, vehicle profiles, sensor identifiers, pressure and temperature readings, diagnostic information, subscription information, support communications, maintenance information and usage information.

    Optional features may request access to Bluetooth, notifications, location, camera, photos, microphone or other device capabilities. You can manage permissions through your device settings, but disabling a permission may prevent the related feature from working.

    20. User Content and Information You Provide

    The App may allow you to enter, create, upload or store information such as vehicle details, tyre information, maintenance notes, photographs, documents, comments or other content (User Content).

    You retain ownership of User Content that you own.

    You grant SAVR a worldwide, non-exclusive, royalty-free licence to host, copy, process, transmit and use your User Content only to the extent reasonably necessary to operate the App, provide requested features, synchronise or back up information, provide support, maintain security and comply with law.

    You must have the right to provide User Content and must not upload unlawful, malicious, infringing or harmful material.

    21. Data Storage, Synchronisation and Loss

    Where the App offers cloud storage, synchronisation, historical records or backups, we take reasonable steps to operate those services reliably.

    No electronic storage or synchronisation system is completely immune from failure, corruption or loss.

    Where information is important to you, retain a separate copy where reasonably practicable. To the extent permitted by law, we do not guarantee permanent retention of data or that every item of data will always be recoverable.

    22. Third-Party Services

    The App may depend on or interact with services provided by Apple, cloud providers, analytics providers, mapping providers, payment processors, telecommunications providers, vehicle infotainment systems and other third parties.

    Those services are not under SAVR's complete control. Your use of a third-party service may also be governed by that provider's terms and privacy policy.

    To the extent permitted by law, SAVR is not responsible for a third party's independent outage, restriction, change or failure.

    23. Intellectual Property

    The App and associated software, interface design, code, graphics, databases, documentation, text, algorithms, trademarks, logos, product names and other proprietary material are owned by SAVR or its licensors and are protected by intellectual property laws.

    SAVR and associated branding may be trademarks of SAVR or its related entities.

    These Terms do not transfer ownership of intellectual property to you or authorise use of SAVR branding in a way that suggests sponsorship, affiliation or endorsement without permission.

    24. Feedback

    If you voluntarily provide suggestions, ideas or feedback about the App, you permit SAVR to use that feedback to develop, improve and commercialise products and services without an obligation to compensate you.

    This does not transfer ownership of your separate confidential information or personal information.

    25. Australian Consumer Law and Mandatory Rights

    Nothing in these Terms excludes, restricts or modifies any consumer guarantee, condition, warranty, right or remedy that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law (ACL).

    If you are a consumer for the purposes of the ACL, goods and services supplied by SAVR may come with consumer guarantees that apply automatically. These rights are in addition to any voluntary warranty SAVR provides.

    Any disclaimer, exclusion or limitation in these Terms applies only to the maximum extent permitted by law and does not operate to remove a mandatory statutory right.

    Where the ACL permits liability for breach of a consumer guarantee relating to services to be limited, and it is fair and reasonable to do so, that liability may be limited to supplying the services again or paying the cost of having the services supplied again.

    This limitation does not apply where the law does not permit it, including where the relevant services are ordinarily acquired for personal, domestic or household use or consumption and the ACL prevents that limitation.

    26. Disclaimers and Limitation of Liability

    Subject to section 25 and to the maximum extent permitted by law:

    • the App is provided on an "as available" basis;
    • we do not guarantee that the App will be uninterrupted, error-free or compatible with every device or system;
    • we do not guarantee continuous sensor communication or that every sensor transmission will be received;
    • we do not guarantee that every tyre problem will be detected or that every warning will be delivered, heard or acted upon;
    • we do not guarantee that use of the App will prevent a tyre failure, breakdown, vehicle damage, accident, injury or other loss; and
    • we are not responsible for loss to the extent it is caused or contributed to by incorrect installation, incorrect settings, failure to maintain tyres or equipment, disabled permissions, depleted batteries, user error, unsafe driving, third-party failures, use contrary to instructions or another matter outside our reasonable control.

    To the extent permitted by law, SAVR is not liable for indirect, special or consequential loss that was not reasonably foreseeable as a result of our breach, or for loss of profit, revenue, business opportunity or data suffered in connection with use of the App, except where such liability cannot lawfully be excluded.

    Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence where liability cannot lawfully be excluded, or any other liability that applicable law requires SAVR to bear.

    27. Responsibility for Misuse

    To the extent permitted by law, you are responsible for loss suffered by SAVR as a direct result of your fraudulent, unlawful or intentional misuse of the App, including reasonable costs arising from a third-party claim caused by that conduct.

    You are not responsible under this section to the extent that the loss was caused or contributed to by SAVR, arose from ordinary good-faith use of the App, or cannot lawfully be imposed on you.

    28. Suspension and Termination

    You may stop using the App at any time. Where available, you may also request deletion of your account, subject to the data-retention matters described in these Terms and our Privacy Policy.

    We may suspend or restrict access where reasonably necessary to protect users or systems, investigate suspected fraud or unlawful activity, comply with law, address a material breach of these Terms or manage discontinuation of a service.

    Where reasonable and legally required, we will provide notice and an opportunity to remedy a breach before termination.

    Terms that by their nature are intended to continue after termination, including intellectual property, liability, governing law and accrued rights, will survive.

    29. International Users, Local Law and Export Compliance

    The App may be made available in multiple countries. If the law where you live gives you mandatory consumer, privacy or other rights that cannot be excluded by contract, those rights continue to apply.

    You are responsible for complying with local road rules, distracted-driving laws and lawful-use requirements applicable to your use of the App and TPMS equipment.

    You must not use, export or re-export the App in breach of applicable export-control, sanctions or trade laws. You must not use the App where doing so would cause SAVR to breach an applicable legal restriction.

    30. Apple App Store Terms

    This section applies if you download or use the App through Apple's App Store.

    30.1 Agreement With SAVR

    These Terms are between you and SAVR, not Apple. SAVR, and not Apple, is solely responsible for the App and its content, subject to applicable law.

    30.2 Scope of Licence

    Your licence to use the iOS version of the App is limited to a non-transferable licence to use the App on Apple-branded products that you own or control, as permitted by the applicable Apple Media Services usage rules, including permitted Family Sharing, legacy contacts or volume-purchasing arrangements where applicable.

    30.3 Maintenance and Support

    SAVR is responsible for maintenance and support of the App to the extent required by these Terms or applicable law. Apple has no obligation to provide maintenance or support for the App.

    30.4 Warranties

    SAVR is responsible for warranties applying to the App to the extent required by law.

    If the App fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price, if any, paid for the App in accordance with its applicable rules.

    To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.

    30.5 Product and Legal Claims

    SAVR, and not Apple, is responsible for addressing claims relating to the App or your possession or use of it, including product liability, consumer-protection, privacy and regulatory claims, to the extent required by applicable law.

    30.6 Intellectual-Property Claims

    If a third party claims that the App or your possession and use of the App infringes that party's intellectual-property rights, SAVR, and not Apple, is responsible for investigation, defence, settlement and discharge of that claim to the extent required by applicable law.

    30.7 Legal Compliance

    You represent that you are not located in a country subject to a United States Government embargo or designated by the United States Government as a country supporting terrorism, and that you are not listed on any United States Government prohibited or restricted-party list.

    30.8 Third-Party Terms

    You must comply with applicable third-party terms when using the App, including applicable wireless-data, telecommunications and device-service agreements.

    30.9 Apple as Third-Party Beneficiary

    Apple and its subsidiaries are third-party beneficiaries of these Terms in relation to your licence and use of the iOS version of the App.

    Upon your acceptance of these Terms, Apple has the right to enforce the applicable provisions against you as a third-party beneficiary.

    31. Events Outside Our Reasonable Control

    To the extent permitted by law, SAVR is not responsible for delay or failure caused by events outside our reasonable control, such as widespread internet or telecommunications outages, cloud-service failures, platform outages, cyberattacks, natural disasters, government restrictions, war, civil disturbance or major infrastructure failures.

    This section does not affect a right or remedy that cannot lawfully be excluded.

    32. Changes to These Terms

    We may update these Terms to reflect changes to the App, new features, legal or regulatory developments, security requirements, platform requirements or changes to our services.

    The current version will show its last-updated date. If a change is material, we will provide reasonable notice where required by law. If your consent is legally required, we will request it.

    Where a material change adversely affects a paid subscription, you may have a right to cancel before the change takes effect or receive another remedy, depending on applicable law and the relevant app-store rules.

    33. General

    33.1 Severability

    If any part of these Terms is invalid, illegal or unenforceable, it will be interpreted or modified to the minimum extent necessary to make it enforceable where possible.

    If that is not possible, it will be severed and the remaining Terms will continue.

    33.2 No Waiver

    If SAVR does not immediately enforce a right, that does not mean the right has been waived.

    33.3 Transfer

    You may not transfer your rights under these Terms except where permitted by law or with our consent.

    SAVR may transfer its rights and obligations as part of a genuine corporate restructure, financing, merger, sale or transfer of the SAVR business, provided this does not unlawfully reduce your rights.

    33.4 Entire Agreement

    These Terms, together with documents expressly incorporated into them, form the agreement between you and SAVR concerning use of the App.

    Separate terms may apply to hardware purchases, warranties, promotions, beta programs or particular services.

    34. Governing Law and Disputes

    These Terms are governed by the laws of Queensland, Australia, subject to any mandatory law applying where you reside.

    You and SAVR submit to the non-exclusive jurisdiction of the courts of Queensland and courts entitled to hear appeals from them.

    Nothing in this section prevents a consumer from exercising a right to bring a claim in another jurisdiction where applicable law gives that right.

    If you have a complaint, please contact us first so we have a reasonable opportunity to investigate and resolve it.

    The App must not be used as a way to contact emergency services. If you are experiencing an emergency, contact the appropriate emergency service for your location.

    36. Acknowledgement

    By downloading, accessing or using the App, you acknowledge that:

    • you have read and understood these Terms;
    • the App and TPMS sensors are supplementary monitoring tools and do not replace responsible tyre and vehicle inspection or maintenance;
    • electronic communications, Bluetooth connections and alerts can fail, be delayed or become unavailable;
    • you remain responsible for the safe operation and maintenance of your vehicle, tyres, caravan, trailer and other equipment;
    • you will not interact with the App in an unsafe or unlawful manner while driving; and
    • your statutory consumer rights remain unaffected where they cannot lawfully be excluded.

    Installation on the caravan was super simple and easy to connect to the app. Haven’t taken the van out yet so can’t comment on real world use yet. Would be good if the app had an option for a caravan (single axle) instead of a motorcycle.
